Terms of Use

These Terms of Use (hereinafter "Terms") aim to define the conditions of access and use of the Sweever platform (hereinafter "the Service"), published by Dukiwi SA.

By creating an account or using the Service, you unreservedly accept these Terms. If you do not accept these conditions, please do not use the Service.

• Service : The Sweever platform, accessible via the website and associated applications.
• User : Any natural or legal person using the Service.
• Account : The User's personal space on the Service.
• Subscription : The subscription contract to a paid offer of the Service.

3.1 Access to the Service requires creating an account. The User must provide accurate, complete and up-to-date information.

3.2 The User is responsible for the confidentiality of their login credentials. Any activity carried out from their account will be deemed to have been carried out by them.

3.3 The User agrees to immediately notify Dukiwi SA of any unauthorized use of their account.

3.4 Dukiwi SA reserves the right to suspend or delete any account in case of non-compliance with these Terms.

4.1 Sweever is an online point of sale (POS) solution enabling:

• Sales and payment management
• Product and inventory management
• POS user management
• Sales statistics tracking
• Receipt printing

4.2 Available features depend on the subscribed plan (Starter, Pro or Enterprise).

4.3 Dukiwi SA reserves the right to evolve the Service at any time.

5.1 The Service is offered according to different pricing plans described on the Pricing.

5.2 Prices are indicated in Swiss Francs (CHF) or Euros (EUR), all taxes included.

5.3 Payment is made by credit card through our secure payment provider Stripe.

5.4 The monthly subscription is charged each month on the anniversary date. The annual subscription is charged once for 12 months, with 1 month free.

5.5 Invoices are available in the customer area and sent by email.

6.1 The User can cancel their subscription at any time from their customer area.

6.2 Termination takes effect at the end of the current billing period.

6.3 No refund is made for the remaining period in case of early termination.

6.4 Upon termination, the User can export their data within 30 days, after which the data will be deleted.

The User agrees to:

• Use the Service in accordance with its intended purpose and these Terms
• Not use the Service for illegal or fraudulent purposes
• Not attempt to compromise the security or operation of the Service
• Not reproduce, copy or resell the Service
• Respect the intellectual property rights of Dukiwi SA
• Keep their account information up to date

8.1 Dukiwi SA is committed to implementing all necessary means to ensure the availability and security of the Service.

8.2 Dukiwi SA cannot be held liable for:

• Service interruptions due to maintenance or force majeure
• Indirect damages resulting from the use of the Service
• Loss of data due to User negligence
• Fraudulent use of the account by a third party

8.3 Dukiwi SA's liability is limited to the amounts paid by the User over the last 12 months.

The processing of personal data is described in our Privacy Policy, which is an integral part of these Terms.

10.1 Sweever, its logo, features and source code are the exclusive property of Dukiwi SA.

10.2 The User has a personal, non-exclusive and non-transferable right to use the Service.

10.3 The User remains the owner of the data they enter into the Service.

11.1 Dukiwi SA reserves the right to modify these Terms at any time.

11.2 Users will be informed by email of substantial modifications at least 30 days before they come into effect.

11.3 Continued use of the Service after the modifications come into effect constitutes acceptance of the new Terms.

12.1 These Terms are governed by Swiss law.

12.2 In case of dispute, the parties will endeavor to find an amicable solution.

12.3 Failing agreement, the courts of the canton of Fribourg, Switzerland, shall have sole jurisdiction.
